Issues: Whether plastic parts of sanitaryware, such as float balls, PVC connections, waste pipes, bottle traps and bends, were classifiable under Heading 3922 as parts of sanitaryware or under the residuary Heading 3926 as articles of plastics.
Analysis: The competing entries were Heading 3922 and the residuary Heading 3926. A residuary heading applies only when no other heading is apt. The items were admittedly parts of sanitaryware, but the decisive question was whether they were shown to be dedicated exclusively to sanitaryware. The department relied on general classification principles, trade notices and the analogy of other plastic articles, but those authorities concerned articles of general use. On the facts, the goods such as float balls and PVC connections were capable of multiple uses, including use in water tanks and other installations, and no evidence was produced that they were specially designed only for sanitaryware or had features confining them to such use.
Conclusion: The goods were not shown to be excluded from Heading 3922 on the facts of the case, and there was no basis to disturb the classification accepted by the Collector (Appeals). The classification under Heading 3926 was not warranted.
