Issue (i): Whether the extended period of limitation was prima facie invocable in view of the exemption claim under Notification No. 1/93 and the declaration filed by the appellants?
Analysis: The appellants had availed the benefit of the small scale exemption and were expected to satisfy themselves that the conditions of the notification were met, including the limit on aggregate clearances from a factory. Filing of a declaration under the trade notice did not, by itself, absolve them of the responsibility to verify eligibility. There was no prima facie material showing that they were misled or that there was any misunderstanding about the eligibility condition relating to the clearance limit.
Conclusion: The extended period of limitation was prima facie rightly invoked.
Issue (ii): Whether the appellants should be fully dispensed from pre-deposit of the duty demand and penalties?
Analysis: The financial position pleaded by the appellants was taken into account, including the meagre profit shown. Balancing that position with the prima facie view on limitation and eligibility, the relief was confined to a limited deposit to secure the interest of justice.
Conclusion: Full waiver of pre-deposit was declined and partial dispensation was granted on condition of a deposit of Rs. 80,000.
Final Conclusion: The appellants were required to make a partial pre-deposit, and only the balance duty and penalties were stayed pending the appeal.
Ratio Decidendi: An assessee claiming small scale exemption must independently satisfy itself about the fulfillment of the notification conditions, and filing a declaration does not by itself negate prima facie invocation of the extended period where eligibility is not shown.
