Issues: Whether rice transplanters in SKD condition were consumer goods under the Import & Export Policy and, if not, whether they were eligible for import under OGL.
Analysis: The goods were agricultural machinery meant for use in the fields by farmers and did not directly satisfy human needs within the policy definition of consumer goods. The relevant appendix to the Import & Export Policy showed seeders, planters and transplanters under heading 8432.30 as freely importable, and no actual user restriction was shown against them. The later policy entry also supported the conclusion that the goods were not restricted consumer goods.
Conclusion: The goods were not consumer goods and were freely importable under OGL. The confiscation and penalty were unsustainable and the appeal was allowed with consequential relief.
Ratio Decidendi: Agricultural implements that do not directly satisfy human needs and are shown in the import policy as freely importable are not consumer goods and cannot be denied OGL clearance on that basis.
