Issue (i): Whether the imported LED Monitor Kit presented unassembled is classifiable under Tariff Item 85285200.
Analysis: Application of Rule 1 of the General Rules for Interpretation directs classification according to the terms of the headings and any relative Section or Chapter Notes. Rule 2(a) of the GRI treats complete or finished articles presented unassembled as classifiable in the same heading as the assembled article where only assembly operations are involved and components are not subjected to further working operations. The HSN explanatory notes and relevant CBIC circular explain that components presented for mere assembly by fixing devices or simple operations fall within Rule 2(a). The imported components cumulatively constitute all parts required to form a complete LED monitor and post-import operations are limited to assembly, minor soldering and testing, which are assembly operations within the scope of Rule 2(a). The monitor description and connectors indicate that the assembled article is a monitor capable of directly connecting to and designed for use with an automatic data processing machine of heading 8471, matching the Tariff Item 85285200.
Conclusion: The imported LED Monitor Kit presented unassembled is classifiable as finished LED Monitor under Tariff Item 85285200 in favour of the applicant (assessee).
Issue (ii): Proper classification of packing and accessory items imported separately or presented with the kits (polybag, gift box, handle, user manual, thank you note, MRP/serial stickers, outer box, transparent seal sticker).
Analysis: Rule 5(b) of the GRI provides that packing materials and packing containers presented with the goods shall be classified with the goods if of a kind normally used for packing such goods; where packing materials are imported separately or are clearly suitable for repetitive use they merit independent classification. Applying GRI and HSN explanatory notes, the packing and accessory items here are either imported separately or are packing materials not forming the essential character of the monitor; they therefore fall to be classified under their respective headings such as CTH 3923 (polybag), 4819 (boxes/cartons), 3926 (handles), 4901 (user manuals), 4821 (stickers/labels) and 3919 (transparent seal stickers) as specified in Table-II of the ruling.
Conclusion: The packing and accessory items are to be classified under their respective tariff headings as set out in Table-II; this conclusion is in favour of the applicant to the extent classification under those headings is accepted.
Final Conclusion: The advance ruling declares that the LED Monitor Kits presented unassembled are classifiable as finished monitors under Tariff Item 85285200 and that the identified packing and accessory items are to be classified under their respective tariff headings as set out in the ruling, producing a favourable classification outcome for the applicant.
Ratio Decidendi: Where a complete or finished article is presented unassembled and only assembly operations are required post-import, Rule 2(a) of the General Rules for Interpretation mandates classification of the imported components as the assembled article; packing materials presented separately or suitable for repetitive use are to be classified under their own headings per Rule 5(b).
