Issues: Whether slag pots or slag ladle cups were classifiable under Chapter Heading 8454.10 as ladles used in metallurgy or metal foundries, or under Chapter Heading 8609.00 as containers specially designed for carriage by one or more modes of transport.
Analysis: The goods were used in metallurgy and foundries for handling and transporting molten slag at very high temperatures and were specifically designed for that function. Chapter Heading 8454.10 expressly covers ladles used in metallurgy or metal foundries, whereas Chapter Heading 8609.00 is a general heading for transport containers. The presence of wheels, under-frames, or a carriage arrangement did not alter the essential character of the goods as ladles. The reasoning applied in the earlier classification of torpedo ladle cars was followed, and the same principle was held applicable here. Since the classification claimed by the assessee was accepted, the Tribunal did not enter into the other issues.
Conclusion: The goods were correctly classifiable under Chapter Heading 8454.10, and the assessee was entitled to the benefit of the notification and consequential relief.
Ratio Decidendi: For tariff classification, a specific heading covering a functional industrial article prevails over a general transport-container heading, and incidental mounting on wheels or an under-carriage does not change the essential character of ladles used in metallurgy or metal foundries.
