Issues: Whether pre-deposit should be waived for the demand under Business Auxiliary Services on the ground that the services were exported because the recipient was located outside India, and whether waiver should also extend to the balance demand and penalties relating to Broadcasting Agency Services where part of the demand had already been paid.
Analysis: The order relied on the Board clarification on the Export of Services Rules, 2005, and on earlier Tribunal decisions to treat services rendered to a recipient abroad as exported where the benefit accrues outside India. On that basis, the Business Auxiliary Services demand was treated as covered for purposes of interim relief. For Broadcasting Agency Services, the amount already paid was noted, and only the balance demand remained for consideration at the stay stage.
Outcome: Pre-deposit of the entire demand under Business Auxiliary Services and the related interest and penalties was waived, and waiver was granted for the balance amount of dues under Broadcasting Agency Services. Recovery was directed to remain stayed till disposal of the appeals, and the stay applications were disposed of accordingly.
