Issues: Whether the imported D.C. Drive and Gear Box complete with electronic control panel constituted permissible spares importable under Open General Licence for actual users, or whether they fell within the banned or non-permissible items in Appendix 3 and Appendix 30 of the Import Policy A.M.81.

Ratio Decidendi: Where imported goods form one inseparable functional unit required as a spare for existing capital goods, they are to be classified by their actual commercial identity and not by splitting them into banned components that do not independently describe the goods.
