Issue (i): Whether telephone cables were correctly classified under Entry 11 of the First Schedule and subjected to tax at 15 per cent, or whether they fell under Entry 41 as electrical goods taxable at 9 per cent.
Analysis: Entry 11 covered sound transmitting equipment such as telephones and loudspeakers, together with spare parts, but did not specifically mention telephone cables. Entry 41 was a residuary entry for all kinds of electrical goods not specified elsewhere in the Schedule, including wires and similar items. On the material placed, telephone cables were treated as electrical goods and the administrative circular relied upon also supported assessment at the single-point rate applicable to electrical goods.
Conclusion: The telephone cables were not assessable under Entry 11 and were taxable under Entry 41 at 9 per cent.
Issue (ii): Whether sales of telephone cables to the Integral Coach Factory, forming part of the Indian Railways, were entitled to the concessional rate of tax applicable to sales in favour of Government departments.
Analysis: The record showed that the Integral Coach Factory was a section of the Indian Railways and that the relevant purchase was made on behalf of the President of India. The governing governmental orders granted a concessional rate for sales of electrical goods to Indian Railways and Central Government departments. On that footing, the buyer fell within the protected class for concessional taxation.
Conclusion: The sales turnover of Rs. 35,026-30 was entitled to taxation at the concessional rate of 3 per cent.
Final Conclusion: The assessment was sustained for the balance of the turnover, but the tax treatment was reduced on the telephone cable turnover and on the sales made to the Indian Railways establishment, resulting in partial relief to the assessee.
Ratio Decidendi: Where a commodity is not specifically covered by a special entry but is an electrical good answering a residuary schedule entry, it is taxable under that residuary entry; sales to Indian Railways or Central Government departments are entitled to the concessional rate when the governing orders so provide.
