Issue (i): Whether the books of account were unreliable and section 145 applied so as to sustain a trading addition.
Analysis: The assessee's accounts showed unverifiable sales, disputed stock shortages, unexplained bardana differences, and excess stock and cash detected in survey proceedings. The accounts were not supported by day-to-day records sufficient to verify consumption and production, and the explanation for bardana shortage was not capable of verification. On the totality of circumstances, the books were found not reliable and the provisions governing rejection of accounts were attracted. While the original addition was reduced after giving effect to the assessee's own disclosure, a substantial trading addition was still considered justified.
Conclusion: The books of account were rightly treated as unreliable and the trading addition was sustained in part, in favour of the Revenue and against the assessee.
Issue (ii): Whether the cash credits were unexplained and liable to addition under section 68.
Analysis: The assessee failed to establish the source and genuineness of several credits appearing in different accounts. The explanations offered for advances, sales adjustments, and withdrawals were held to be unusual and unsupported by confirmations or reliable evidence from the creditors' records. The burden under section 68 remained on the assessee and was not discharged in respect of the impugned credits.
Conclusion: The additions on account of unexplained cash credits were upheld, against the assessee.
Issue (iii): Whether the grounds relating to partner remuneration and share allocation required fresh determination.
Analysis: The dispute on partner interest and salary, and the related question of allocation of interest received in individual and representative capacities, had not been finally examined on the relevant factual and legal footing. The matter was therefore restored for fresh adjudication after giving the parties an opportunity to address the issue.
Conclusion: These grounds were remanded for fresh determination in accordance with law, in favour of the assessee to that extent.
Final Conclusion: The appeal succeeded only to a limited extent, with some additions sustained, some issues remanded, and the assessment left otherwise undisturbed.
Ratio Decidendi: Where account books are found unreliable on account of unverifiable discrepancies and the assessee fails to discharge the burden of proving the source and genuineness of cash credits, additions under the relevant provisions are justified; ancillary issues requiring factual verification may be remitted for fresh decision.
