Issue (i): Whether the appeal against the order under section 154 of the Income-tax Act, 1961 was maintainable.
Analysis: The objection of the Department was that the matter was not appealable. The challenged order was, however, one made under section 154 and not merely an order under section 139(8), and the appellate authority was right in treating the appeal as maintainable.

Issue (ii): Whether the rectification enhancing interest under section 139(8) of the Income-tax Act, 1961 could be sustained despite the effect of rule 119A of the Income-tax Rules, 1962.
Analysis: Although section 139(8) by itself supported charging interest for the period in question, the provision had to be read with rule 119A. On that reading, the matter was not free from doubt because the expression 'month' in rule 119A was treated as a calendar month and the default could not be mechanically extended beyond the relevant month. Since a genuine scope for debate existed, the matter did not involve a mistake apparent from the record and could not be rectified under section 154.
Conclusion: The rectification could not be sustained and section 154 was wrongly invoked.
