Issues: Whether the suspension of the Custom House Agent licence was justified when the goods were examined by Customs officers and no lapse on the part of the CHA was shown.
Analysis: The goods were examined 100% by the Customs officers and the alleged explosives or missiles were not detected even at that stage. The CHA had only filed the import documents on the basis of papers supplied by the importer and had accompanied the officers as an agent of the importer. Regulation 13 of the CHA Licensing Regulations, 2004 did not cast any obligation on the CHA to conduct or assist in examination of the imported goods. No material was shown to establish any lapse by the CHA warranting continuation of suspension, and the impugned suspension was therefore not justified.
Conclusion: The suspension of the CHA licence was unjustified and was set aside; the appeal was allowed.
Final Conclusion: The licence suspension could not be sustained in the absence of any demonstrated obligation breached by the CHA, while leaving the authorities free to proceed if later investigation revealed involvement in the import offence.
Ratio Decidendi: A CHA cannot be saddled with responsibility for detecting concealed contraband in goods examined by Customs officers, and suspension of licence cannot be continued without material showing a lapse within the CHA's regulatory obligations.
