Issues: (i) Whether the seized gambier was proved to be of foreign origin and smuggled into India so as to justify confiscation. (ii) Whether the penalty and redemption fine required interference.
Issue (i): Whether the seized gambier was proved to be of foreign origin and smuggled into India so as to justify confiscation.
Analysis: The bags bore markings suggesting Singapore origin and movement through Nepal. The purchase bills relied upon by the appellant were verified, but they did not satisfactorily establish lawful acquisition of the entire seized quantity. The explanation regarding local purchase was found inconsistent with the evidence concerning repacking and the markings on the bags. On this material, the goods were treated as foreign-origin goods brought into India from Nepal.
Conclusion: The confiscation was upheld.
Issue (ii): Whether the penalty and redemption fine required interference.
Analysis: Although confiscation was sustained, the facts and circumstances did not justify the quantum originally imposed. The value and circumstances of seizure warranted some relief by way of redemption on payment of fine, and the penalty was considered excessive.
Conclusion: The redemption fine was fixed at Rs. 2 lakhs and the penalty was reduced to Rs. 3 lakhs.
Final Conclusion: The appeal succeeded only to the extent of reduction in the monetary consequences, while the confiscation of the goods remained intact.
Ratio Decidendi: Where the evidence, including markings on the goods and the failure of the appellant to prove lawful acquisition, indicates foreign origin and smuggling, confiscation is sustainable, but the quantum of fine and penalty may be moderated on the facts of the case.
