SANGH U.P. & ORS. - TMI The Supreme Court dismissed the appeal filed by the State of Uttar Pradesh challenging the High Court's order directing the grant of pay scale Rs. 7500-12000 to Sub Deputy Inspectors/Assistant Basic Shiksha Adhikaris and Deputy Basic Shiksha Adhikaris. The High Court's relief was grounded on the anomaly that, after a pay scale revision by Government Order dated 20th July 2001, Head Masters' pay scales were fixed higher than those of the respondents, despite previously being lower. The Government revised Head Masters' pay scales to align with Central Government employees but did not correspondingly revise the respondents' pay, prompting the High Court to issue directions to rectify this disparity. The Supreme Court found no error in the High Court's directions and noted that the Government itself acknowledged the anomaly. Proceedings dated 12th May 2010 from the Finance Department confirmed a decision to rectify pay discrepancies for Deputy Inspectors of Schools/Deputy Basic Education Officers, granting the pay scale Rs. 7500-12000 effective from 1.12.2008. Although the Government intended to file this decision in Court, it did not do so. Given the Government's acceptance and decision to implement the revised pay scales, the Court held that no further adjudication was necessary and dismissed the appeals, emphasizing that the Government 'cannot go back from implementing the same.'
