Curative Petition - Denial of CENVAT Credit - Imposition of penalty - the decision in thecase of [2015 (5) TMI 447 - SUPREME COURT] contested - Held that: - We have gone through the Curative Petition and the relevant documents. In our opinion, no case is made out within the parameters indicated in the decision of this Court in Rupa Ashok Hurra v. Ashok Hurra and Another [2002 (4) TMI 889 - SUPREME COURT] - petition dismissed - decided against petitioner. The Curative Petition was examined against the standards laid down in Rupa Ashok Hurra v. Ashok Hurra, 2002 (4) SCC 388. The Court concluded that 'no case is made out within the parameters indicated in the decision of this Court in Rupa Ashok Hurra v. Ashok Hurra and Another, reported in 2002 (4) SCC 388.' Applying that precedent, the petition failed to meet the stringent threshold required for reopening final judgments via a curative petition. On that basis, the Curative Petition is dismissed.
