Issues: Whether a hand-driven lorry left standing in a public street with goods for sale fell within Section 152 of the Bombay Municipal Boroughs Act, 1925.
Analysis: The words in Section 152 concerning deposit of a box, bale, package, merchandise or any other thing in a public place or street were construed as referring to articles of the same class. The expression "any other thing" was read ejusdem generis with the preceding words and was held not to include a vehicle. A hand lorry was treated as a vehicle within the statutory definition, and the provision was held not to extend to vehicles merely because they contained merchandise or remained stationary in the street.
Conclusion: The hand-driven lorry did not fall within Section 152, and the convictions were unsustainable.
