Issues: Whether the appeal challenging the National Commission's direction to pay interest on the amounts deposited by the respondent till allotment and delivery of possession of a new plot warranted interference.
Analysis: The appellant's own written statement before the National Commission undermined the basis of the appeal. The respondent had sought compensation for having to remain in rented accommodation, and the National Commission had instead directed payment of interest at 18% per annum on the deposited amounts until a new plot was allotted and possession delivered. In view of the facts and the effect of the vacation of the stay order, no justification was found for disturbing that direction.
Conclusion: The appeal was not entertained on merits and the direction to pay interest stood affirmed in favour of the respondent.
