Appeals on such administrative decisions were not ... - The Revenue's appeal against the Commissioner of Customs' renewal of a CHA licence under Regulation 10(2) of the Customs House Agents Licensing Regulations, 1984 was rejected as not maintainable. The Tribunal applied precedent: A.S. Vasan & Sons v. Commissioner of Customs (General), Mumbai 2008 (230) ELT 374 (upheld by the Bombay High Court 2009 (238) ELT 217) and relied on M. Dutta Agency v. Commissioner 1998 (1) LCX 77, P. Cawasji & Co. 2000 (119) ELT 606, G.P. Jaiswal 2008 (226) ELT 707 and Tass Clearing Services P. Ltd. v. Commissioner of Customs, Hyderabad 2009 (238) ELT 671. Those authorities hold that an order relating to renewal of a CHA licence is 'administrative in nature and not a quasi-judicial order against which an appeal is maintainable before the Tribunal.' Applying that ratio, the appeal was dismissed as not maintainable; the cross-objection was dismissed as merely comments/reply to the Revenue's appeal.
