Issues: Whether, in an interlocutory proceeding arising out of a high seas sale transaction, the seller retained a lien over the coal till full payment was made and whether the purchaser could be permitted to lift the remaining quantity of coal on depositing the amount directed by the High Court.
Analysis: The parties had entered into a high seas sale arrangement for import and purchase of coal, under which the seller claimed unpaid sale consideration and sought protection of the remaining cargo. The Court noted that the agreement contemplated payment of the full price before the seller's rights in the goods stood fully transferred, and that the seller's lien and the purchaser's obligation to lift the goods were relevant to the interlocutory protection granted by the courts below. At the same time, the Court avoided finally pronouncing on the ultimate rights of the parties at the interim stage and confined itself to the balance between protection of the seller's claimed dues and the purchaser's right to obtain delivery on payment.
Conclusion: The petition was disposed of by modifying the High Court's order so that, on deposit of the amount directed after deduction of the price of coal already lifted, the purchaser would be entitled to lift the remaining coal; failing such deposit, the High Court's order would continue to operate.
