Issues: Whether cancellation of registration could be sustained when the notice proposed cancellation on one set of grounds but the final order rested on different grounds, and whether such action offended the principles of natural justice.
Analysis: The notice for cancellation and the order of cancellation were founded on different aspects. Cancellation on grounds not contemplated in the notice deprived the dealer of a proper opportunity to meet the case against it. Such departure from the notice amounted to a breach of audi alteram partem. The Tribunal's view that the registration had been cancelled without a valid hearing was therefore justified.
Conclusion: The cancellation of registration was vitiated for want of proper notice and hearing, and the revision failed.
Ratio Decidendi: An administrative cancellation order cannot be sustained where it is based on grounds materially different from those stated in the show-cause notice, because that denies the affected party a fair opportunity of hearing.
