Issue (i): Whether Modvat credit could be denied merely because the declaration was filed under Rule 57J of the Central Excise Rules, 1944 instead of Rule 57G of the Central Excise Rules, 1944.
Analysis: The inputs were sent directly to a job worker and the appellant had already filed a declaration disclosing the inputs and the intended availment of credit. The declaration satisfied the substantive purpose of putting the Department on notice. The objection that the declaration cited Rule 57J rather than Rule 57G was held to be only technical and procedural.
