Issues: Whether the order rejecting the appeals suffered from a mistake apparent from the record on the ground that the applicants had been acquitted by the High Court in the prosecution proceedings.
Analysis: The High Court proceedings were criminal in nature and required a higher standard of proof, whereas the tribunal proceedings were quasi-criminal and were decided on the basis of statements and other evidence on record. The absence of any reference to the High Court's acquittal in the tribunal order did not, by itself, constitute an error apparent from the record.
Conclusion: The request for rectification was not maintainable and the ROM applications were rejected.
