Issue (i): Whether credit was admissible on welding electrodes.
Analysis: The larger bench decisions relied upon held that welding electrodes are not eligible for credit. In view of that binding view, the claim for credit on welding electrodes could not be sustained.
Conclusion: Credit on welding electrodes was inadmissible and the disallowance was upheld.
Issue (ii): Whether credit was admissible on SE copper wire and copper wire.
Analysis: The items were treated as eligible for credit in the light of the larger bench view that a declaration filed for the relevant credit scheme was sufficient for extending credit, and the assessee's claim as inputs was accepted on the facts recorded.
Conclusion: Credit on SE copper wire and copper wire was allowed.
Issue (iii): Whether credit was admissible on Read Lead, Chem Floc, Mafloc and Chem Mash, and whether penalty was sustainable.
Analysis: Read Lead was found to be used to prevent leakage in the boiling house, and the other chemicals were found to be used in the manufacturing process and to be inevitable for manufacture of sugar. The adjudicating authority's finding that such chemicals were eligible inputs under Rule 2(k) of the Cenvat Credit Rules, 2004 was accepted. Since the credit dispute was resolved in favour of the assessee on the remaining items, the penalty was held not warranted.
Conclusion: Credit on Read Lead, Chem Floc, Mafloc and Chem Mash was allowed, and the penalty was set aside.
Final Conclusion: The appeal succeeded only to the extent of denial of credit on welding electrodes being sustained, while credit was granted on the remaining items and the penalty was deleted.
Ratio Decidendi: Credit is admissible only for items shown to be used in relation to manufacture as eligible inputs, while welding electrodes were excluded by the binding larger bench view.
