Issues: Whether the appellants had made out a prima facie case for waiver of pre-deposit and stay of recovery in respect of duty demand and penalties, in the context of MRP-based valuation and the applicability of the Packaged Commodities Rules.
Analysis: The goods in question comprised three items, of which plugs and sockets were found not to have been imported in packaged condition, while MCCBs were packed in single pieces with a declaration that they were specially packed for exclusive industrial use and not intended for retail sale. The declaration was held to be in consonance with Rule 34 of the Standards of Weights and Measures (Packaged Commodities) Rules, 1977, and there was no ambiguity in the wording used. The subsequent sale by customers to non-industrial users did not negate the appellants' declaration. It was further observed that even if MRP-based assessment were assumed to apply, in the absence of prescribed rules for determining MRP where none was declared, the adjudicating authority could not determine MRP on its own.
Conclusion: The appellants were held entitled to waiver of the entire pre-deposit and stay of recovery pending disposal of the appeal.
