Issues: (i) Whether the logo 'APOILFED' on the pouch, though the word 'Vijaya' was absent, amounted to use of a brand name or trade name so as to deny exemption on the cleared goods. (ii) Whether penalty under Rule 25 was sustainable.
Issue (i): Whether the logo 'APOILFED' on the pouch, though the word 'Vijaya' was absent, amounted to use of a brand name or trade name so as to deny exemption on the cleared goods.
Analysis: The relevant exemption notification defined brand name broadly enough to cover a mark or writing indicating a connection in the course of trade between the goods and the person concerned. The pouch carried the appellant's logo, which was held to be sufficient to identify the goods with the appellant's business. The distinction from cases involving a mere house mark was not accepted in the facts of the present case, and the reasoning adopted in the adjudication order was found to be correct in the light of the applicable Supreme Court ruling on trade name usage.
Conclusion: The pouch bearing the APOILFED logo was held to fall within the mischief of brand name or trade name use, and the demand of duty and interest was upheld against the assessee.
Issue (ii): Whether penalty under Rule 25 was sustainable.
Analysis: The dispute turned on interpretation of the expression brand name. The assessee's conduct was treated as arising from a bona fide belief on a contentious exemption question, and no separate basis was found for penal action on the facts.
Conclusion: The penalty was set aside in favour of the assessee.
Final Conclusion: The appeal succeeded only to the extent of deletion of penalty, while the duty and interest demand was sustained.
Ratio Decidendi: For exemption notifications using the expression brand name or trade name, a company logo or mark that identifies the goods with the assessee and indicates a commercial connection can amount to brand name use even if the product name itself is absent; penalty is not justified where the dispute is purely interpretative and the assessee acted under bona fide belief.
