Issues: (i) Whether the miscellaneous application for retention of the file in the Bench was liable to be allowed on the basis of the appellant's office location; and (ii) whether the appellants had made out a prima facie case for unconditional stay of pre-deposit and recovery in view of the circular on overheads and selling expenses in assessable value.
Issue (i): Whether the miscellaneous application for retention of the file in the Bench was liable to be allowed on the basis of the appellant's office location.
Analysis: The appellant's certificate of registration showed that its office was situated in Bangalore, which fell within the jurisdiction of the Bench. The request for retention of the file in that Bench was therefore supported by the jurisdictional facts placed on record.
Conclusion: The miscellaneous application was allowed.
Issue (ii): Whether the appellants had made out a prima facie case for unconditional stay of pre-deposit and recovery in view of the circular on overheads and selling expenses in assessable value.
Analysis: The dispute at the interim stage concerned inclusion of overheads and selling expenses in the assessable value. The appellants relied on a Board circular clarifying that overheads and cost of production for captive consumption, including selling expenses, need not be added in assessable value. On that basis, the Tribunal found a strong prima facie case in favour of the appellants for interim relief.
Conclusion: Unconditional stay was granted and recovery was restrained until disposal of the appeal.
Final Conclusion: Interim relief was granted to the appellants on the strength of the departmental circular and the jurisdictional basis for retaining the matter in the Bench.
Ratio Decidendi: Where the departmental circular supports exclusion of the disputed elements from assessable value and the appellant demonstrates a strong prima facie case, unconditional interim stay and protection from recovery may be granted.
