Issues: Whether the appellant was entitled to full waiver of pre-deposit and stay of recovery in respect of duty demand on strips of medicines brought back for reprinting of prices pursuant to Drug Price Orders.
Analysis: The duty demand related to medicine strips returned for reprinting of lower prices under Drug Price Orders. In view of Board's Instructions No. 576/13/2001-CX. dated 16-05-2001, such claims were found, prima facie, not to be maintainable in the manner sought by the revenue. On that basis, the appellant was held entitled to full waiver of pre-deposit and protection against recovery pending disposal of the appeal.
Conclusion: Full waiver of pre-deposit was granted and recovery was stayed in favour of the appellant.
