Issues: Whether the appellants had made out a prima facie case and sufficient grounds for complete waiver of pre-deposit of the duty, penalty and personal penalty pending appeal.
Analysis: The amounts were confirmed on the finding that the appellants had taken Modvat credit on raw materials which were not used in the manufacture of HDPE pipes as per DoT specifications. The technical reports indicated that the granules in question were not suitable for manufacture of the specified pipes. In view of these findings, the appellants did not establish a strong prima facie case. Considering the facts, the Tribunal balanced the appellants' financial difficulty against the merits of the case and found partial waiver appropriate.
Conclusion: Complete waiver was refused. The appellants were directed to pre-deposit Rs. 35 lakhs within eight weeks, with recovery of the balance duty and penalty stayed during the pendency of the appeals. Waiver of the personal penalty of Rs. 10 lakhs was allowed.
