Issues: Whether the applicants were entitled to waiver of pre-deposit and stay of recovery pending appeal, having regard to the disputed Modvat credit demand and the plea of hardship.
Analysis: The applications arose from demands confirmed on the basis that Modvat credit had to be reversed on conversion of the unit into a 100% EOU and on alleged incorrect availment of credit. The applicants specifically contended that credit had been taken only on certain goods, that the disputed documents related to goods on which no credit had been taken, and that the remaining credit had been reversed on conversion. This plea was supported by reference to the RG 23A register, but the Commissioner did not examine this material aspect. The Tribunal also noted the plea based on the Board's Circular No. 77/99 dated 18-11-1999 and the financial hardship shown by the applicants.
Conclusion: The applicants established a fit case for waiver of pre-deposit and stay of recovery.
