Negative List of Services - Service Tax - Budget 2012-13

Santosh Kumar
India's 2012-13 Budget Introduces Negative List of Services Exempt from 12% Service Tax, Simplifying GST Framework. The Negative List of Services introduced in the 2012-13 budget outlines services exempt from the 12% service tax, aligning with global practices as part of India's GST regime. Exempt services include those provided by the government or local authorities, except when competing with the private sector, and cover areas like education, public transport, agriculture, and residential renting. The negative list aims to simplify the service tax framework by reducing service definitions from 290 to 54 and exemptions from 88 to 10. Key exempt services include those related to agriculture, education, public transportation, and certain financial transactions. (AI Summary)

Negative List of Services

  • The services not under the negative list will attract 12 percent service tax.
  • The services that comprise the negative list include those provided by the government or local authorities, except a few specified services where they compete with private sector.
  • The list also includes pre-school and school education, recognised education at higher levels and approved vocational education, renting of residential dwellings, entertainment and amusement services and a large part of public transportation including metered cabs, and agriculture and animal husbandry.
  • The negative list concept is practiced globally and is proposed to be introduced in India as part of the goods and services tax (GST) regime.
  • Movement towards the negative list will result in reducing nearly 290 definitions and descriptions in the Act to 54, and the exemptions from the existing 88 to 10
