Appeal for re-examination is available where a person is declared unfit for employment in mines, a particular category of mines, or specified operations in a mine on the basis of an initial or periodical medical examination. The person may, within thirty days of receiving the certificate, file an appeal with the employer and seek medical re-examination by an appellate medical board. The employer or mine manager must forward the appeal within fifteen days, notice must be given for re-examination, and fees are payable by the appellant subject to reimbursement if the person is found fit.
