State power to remit, suspend or commute sentences is limited where offences implicate central functions or property: the State may not exercise remission or commutation powers in cases investigated by agencies empowered under Central law, affecting central government property, or involving persons in Central service acting in official capacity, except with Central Government concurrence; and State orders on concurrent sentences covering offences within Union executive power have no effect unless the Central Government makes a corresponding order for the Union-related offences.
