Cognizance of offences requires prior sanction, restricting initiation and trial jurisdiction accordingly under the Act.

Cognizance of offences under the Act is conditioned on the previous sanction of the Commissioner and only courts not inferior to a Magistrate of the First Class may try such offences, thereby delimiting initiation of prosecution and the competent trial forum.
