Leave to sue LLP requires Tribunal permission and notice to the liquidator and existing parties before commencing.

Rule 122 requires that any application for leave to commence or continue a suit against an LLP be made to the Tribunal and served on the Liquidator and the parties to the suit. Applications to transfer suits or proceedings pending in courts or tribunals (other than the High Court or Supreme Court) to the Tribunal must likewise be made on notice to the Liquidator and to the parties to the pending proceeding.
