....oreign Corona Economic Stimulus - Taxable or Tax Exempt in India - FAST-DS 2026
Query (Issue) Started By: - Trinity Dated:- 6-9-2026 Last Reply Date:- 7-9-2026 Income Tax
Got 4 Replies
Income Tax
Dear Experts I'd like to know if the money received as Corona Stimulus Economic Package from the US is taxable in India or not. Per the IRS it is tax free in the US. Per the internet Treated as a Non-Taxable Relief Grant (Not Income) - Under the Indian Income-tax Act, a receipt is only taxable if it falls under the specific definition of "income" (such as salary, business profits, capital gains, or other regular streams). The COVID-19 stimulus payment from the U.S. Treasury is a social benefit or disaster relief gran....

....t. It does not arise from any service rendered, employment, or investment activity in India, making it a capital receipt/personal relief aid rather than income. Classified as a Government Aid - In general tax principles, personal transfers or government aid given as financial relief do not qualify as taxable commercial or professional receipts. Even though resident Indians are technically taxed on global income, statutory relief grants meant for public welfare do not possess the character of earned income or commercial revenue, meaning they are excluded from taxable computation under the Income Tax Department of India Furthermore, the reason for asking this is because the user is interested in applying for the FAST-DS 2026 schem....

....e. 1. The asset being declared under this scheme is a US bank a/c under Cat B (flat fee) route 2. The requiement for this bank a/c is 'Sum of ALL deposits'. The bank a/c was opened while NRI for salary 3. All the deposits in the users account was income that was taxed in the US. Upon becoming a resident, the US Treas deposited Corona Relief stimulus 4. Will this Corona stimulus be considered taxable or tax exempt during the FAST-DS 2026 filing I am grateful for your expertise and response in advance Sincerely Trinity Reply By Ryan Vaz: The Reply: The US stimulus payment is likely taxable in India unless specifically exempted. Absent specific CBDT guidance, the default position is that global income of India....

....n residents is taxable. Key Considerations: Nature of Payment: US EIP is a tax rebate/credit, not compensation for services. However, Indian tax law does not explicitly exempt such payments. FAST-DS 2026 Cat B: You must disclose the US bank account with the sum of all deposits, including the stimulus amount. Declaration: Show the stimulus as income in ITR under "Income from Other Sources." You may claim exemption under Section 10(24) (foreign grant-in-aid) but this is arguable. Documentation: Maintain records proving the payment is a US government tax rebate, not earned income. Practical Approach: Declare the US bank account in FAST-DS 2026 with the total deposits including stimulus Report the stimulus as taxable inc....

....ome in ITR If claiming exemption, cite Section 10(24) and document the payment's nature Contact me, for final advice given the grey area as informed yesterday on email Risk: Treating as exempt without statutory backing invites scrutiny. The safest compliance position is disclosure as taxable income. Note: No specific CBDT ruling directly addresses this. The India-US DTAA (Article 21) may apply to government payments, but professional advice is recommended given the ambiguity. Reply By Sanjeev Agarwal: The Reply: Assuming the U.S. payment was genuinely an IRS Economic Impact Payment (EIP) / Recovery Rebate Credit, the stronger Indian-tax position is that it is not taxable income in India. It was a statutory U.S. refundab....

....le tax-credit payment, rather than salary, business/professional income, investment income or consideration for services. The fact that it is tax-free in the U.S. supports its character, but U.S. tax treatment by itself does not determine Indian taxability. I would not rely primarily on the argument that it is a "capital receipt" or that all government relief is automatically exempt. The better argument is that the payment does not have the character of taxable income under Indian law. In the absence of a specific Indian CBDT clarification or judicial ruling on U.S. EIPs, the position is Strong / Reasonably Defensible, rather than completely settled. FAST-DS 2026 - critical distinction Non-taxable does not necessarily mean excluded fr....

....om FAST-DS valuation. For a foreign bank account under Category B, the valuation is based on the sum of deposits into the account from the date of opening up to 31 March 2026, subject to the specific exclusions under the scheme. Therefore: • EIP deposited on or before 31 March 2026 generally included in the "sum of all deposits" for FAST-DS, even though the EIP itself is non-taxable. • EIP deposited after 31 March 2026 generally not included in the 31 March 2026 FAST-DS valuation. Thus, the payment can be non-taxable for Indian income-tax purposes but still included in the FAST-DS bank-account valuation. Your historical U.S. salary deposits, earned while you were NRI, require separate analysis but may....

.... fall within the Category B framework, subject to satisfaction of all conditions. Before filing, verify the exact IRS payment. The bank statement description, payment date and IRS records should establish whether it was actually an EIP/Recovery Rebate Credit. This is important because an IRS Treasury deposit could alternatively represent a normal tax refund or another payment, which may have a different Indian-tax treatment. Reply By Trinity: The Reply: Dear Mr Vaz - Fist and foremost, thank you for your time and expertise on how to look at this deposit from the US Govt.. It appears that failing an 'explicit' mention by the CBDT on how to treat this deposit, it is left to the filer to opt for the 'hard way' and pay the tax and en....

....ter it in 'Fast-DS'. What hurts my soul even more is the negative heading under which it will be applied 'Undisclosed Income' which sounds very wrong as this can be interpreted negatively when all that happened is that I receivd a 'Corona Stimulus' which I am now trying to regulaize via Fast-ds. I am unsure to tke the risk and file without declaring this explicitly as it might jeapordize th filing and mor importantly there's no detailed 'recourse or support' post filing. the wording says 'all declartions are final' which I see as no chance to correct genuin misinterpretation. Reply By Trinity: The Reply: Dear Mr. Agarwal - Thanks for your time and breakdown of the possibilities. Yes the bank account will include the EIS paymnts in '....

....Sum of all deposits'. All the EIS deposits are listed as - Direct Deposit - IRS Treas 310 XXXXXXXXXXX0908 on the bank statement, but they total to exactly what the EIS would pay out for a married couple. $10,700 With this description, would one be able to confidently exclude this tranche of payments by the US Govt, or, would we have to include it and pay 60% as tax on it which is a steep amount to pay just because we dont have claity on whether they qualify as 'Tax Exempt'. I am torn because there's no official confirmtion and the alternative would mean Id have to use the 31st Mar 2026 exch rate or will there be a different sxch rate that one can use to calculate this 'tax' . Looking forward to your valuable expertise and reponse a....
