It is well settled principle of taxation that in absence of mechanism for collection of tax, the levy fails/refer e.g. the judgment of Supreme Court in the case of CIT, Bangalore v. B.C. Srinivasa Setty (supra). Thus, we hold that electronically downloaded software is not liable to Customs duty. Consequently, the demand of service tax relating to electronically downloaded software is not sustainable even for such downloads in respect of which OIPL remitted licence fee to Oracle USA.
