AR has taken me through the impugned order and stated that there is a delay in filing of the appeal before the Commissioner Appeal which is beyond the powers of condonation as per the Statute. Further the appellant has not paid the pre-deposit as required under section 35 F of the Central Excise Act 1944 (CEA) read with section 83 of the Finance Act 1994 (FA).
