" The material facts giving rise to this reference as set out in the statement of case are as follows: The assessee, a registered firm, derived income mainly from wholesale business in cloth at Indore City and from sales outside Indore. In the assessment year 1970-71 the assessee-firm had two partners, Ramlal and Madanmohan. Ramlal's share in the firm was 50% and that of Madanmohan was 25% in profits only. ....g aggrieved by the order of the Tribunal, the assessee sought reference to this court. The application of the assessee for that purpose was dismissed by the Tribunal. The assessee then submitted an application to this court under s. 256(2) of the I.T. Act, 1961, which was allowed. At the direction of this court the Appellate Tribunal has referred the aforesaid question of law for the opinion of this court. We have heard the learned counsel for the parties.
