....or capital goods although they have become obsolete but are lying in the said factory; duty is payable only at the time of removal of such inputs. The case laws cited by the Ld. JCDR in the case of RPG Cables Ltd., cited supra is not relevant to the facts of this case. In that case it was admitted that the inputs were not physically available in the factory after being written off. In this case, show-cause notice clearly shows in paragraph 29 that the inputs removed from financial accounts for the year 1996 onward continued to remain in stores accounts even today awaiting its removal from the stores as well as for reversal of credit. Therefore, following the above cited judgments, the appellants are not required to reverse the Cenvat Credit....
