Since GST is in place now builder is asking us to pay 12% GST on the pending slab though we have booked the flat before July itself rather than 4.9% earlier service tax. This is creating a burden of additional 4 lakhs on us. I believe that builder should not ask increased tax slab since we have booked before GST implementation....

....shna: The Reply: In previous tax regime service tax @ 4,5% (under 26/2012 notification) and VAT (1.25% or 1%) was applicable for sale of construction of Flat (till the date of receipt of Occupation Certificate). As mentioned the builder should have discharged Service Tax & VAT ( hope Karnataka govt also issued circulars to discharge VAT till date of receipt as against the earlier practice of pay....
