It appears to us that, ordinarily, an EOU is liable to determine the duties of Customs leviable on their finished goods cleared to DTA, as if such goods were produced outside India and imported into India, and then pay to the Revenue half of the amount so quantified as duty of excise on the DTA clearances. Notification No. 2/95-C.E., referred to by learned SDR exempted payment of 50% of this duty. Thus, the provisions of Section 3(1) of the Central Excise Act read with Notification No. 2/95-C.E. governed payment of duty on DTA clearances made by EOU in ordinary situation.
