Commissioner (AR) appearing for the Revenue, on the other hand, contends that the amendment to the Cenvat Credit Rules, 2002 was made vide Notification No. 13/2003-C.E., dated 1-3-2003 and the said amendment should be considered only as prospective. Section 88 of the Finance Act, 2004 which granted retrospective effect, amendment carried out also specifies the date of effect to the amendment as from 1-3-2003 and, therefore, the appellant could not have utilized the credit prior to 1-3-2003.
