We find that in the present case addition on account of Work in progress was initially made at Rs. 29,14,430/- which was scaled down to Rs. 10,96,700/- by Tribunal. On the amount of addition which was finally upheld, penalty u/s. 271(1)(c) was levied by A.O. 7. The penalty under section. 271(l)(c) of the Act is leviable if the AO is satisfied in the course of any proceedings under the Act that any person has concealed the particulars of his income or furnished inaccurate particulars of such income.
