SDR, however, points out that the appellants have not produced any evidence to show that Mafron gas is a brand name of Freon gas. However, he does not dispute that it is a refrigerant gas and assessed as such for excise purposes. He however contends that specific description should be given in the Modvat declaration for claiming Modvat benefit.
