....sub-rule (4) of Rule 233(B) would not arise. That would not, however, mean that duty had not been paid under protest. The said sub-rule would apply only if such documents are there at the material time. Hence no violation of the said sub-rule can be said to have taken place and accordingly sub-rule (8) would not come into play.
