of <h1>Companies Act Transition: Pending Cases Shift from 1956 Act to Tribunal Under 2013 Act, Effective Dec 15, 2016.</h1> The Companies (Removal of Difficulties) Fourth Order, 2016, issued by the Ministry of Corporate Affairs, addresses the transfer of pending proceedings from the Companies Act, 1956 to the Tribunal under the Companies Act, 2013. Effective from December 15, 2016, proceedings unrelated to winding-up will be transferred to the Tribunal, except those reserved for orders by High Courts. Winding-up cases pending in High Courts, where petitions haven't been served, will also move to the Tribunal. The order aims to resolve issues arising from the transition between the 1956 Act and the 2013 Act, ensuring proceedings are handled appropriately.
