Summary: A civil company court is precluded from restraining or displacing actions lawfully taken by secured creditors under the SARFAESI Act; the Act bars civil suits and injunctions in respect of matters within the Debt Recovery Tribunal or Appellate Tribunal's competence and its non obstante clause gives it primacy over inconsistent laws. Enforcement steps, including notices, symbolic possession and sale of secured assets, must be challenged through the statute's prescribed recovery and appeal mechanisms rather than by collateral proceedings in a company court.
