      Summary: Amendment increases the Special Additional Excise Duty on Diesel by substituting the previous entry in the Table of Notification No. 04/2022-Central Excise with a revised per litre duty; the Central Government exercised powers under the Central Excise Act and the Finance Act and brought the change into force the day following notification.

No. 1) with a revised per tonne duty and replacing the rate for export of Aviation Turbine Fuel (S. No. 2) with a revised per litre duty, effected under statutory tax powers and specifying the date the revisions come into force.

      Summary: The notification amends the customs tariff schedule by substituting three tables to fix tariff values in US dollars for specified imported goods, including edible oils (various palm and soybean oil entries), brass scrap, areca nuts, and defined forms of gold and silver, and provides explanatory qualifications for certain precious metal entries; the amendment is effected under section 14(2) of the Customs Act, 1962 and specifies an effective date for the new values.

EOUs/SEZs must pre-import wheat, export resultant flour within 180 days, comply with actual user conditions, forbid transfer of imported raw material including job work, export entire milling output except approved wastage, and produce the imported wheat Bill of Entry at export clearance. A separate Export Authorisation will permit a capped quantity under notified modalities.

      Summary: Specification of the sovereign wealth fund Norges Bank On Account Of The Government Pension Fund Global as a specified person for exemption under the income-tax exemption clause for income from investments in India made on or after publication and on or before the thirty-first day of March two thousand thirty, subject to conditions: timely return filing, statutory audit with prescribed audit report, quarterly electronic reporting, maintenance of segmented accounts, continued ownership and control by the Government of Norway, regulation under Norwegian law, earnings credited to government-designated account, prohibition on borrowings for investment in India, asset vesting in the Government on dissolution, and no day-to-day participation in investees.

      TRADE CIRCULAR No. 08/2022 - dated 29-9-2022
      Manner of filing refund of unutilized ITC on account of export of electricity
      Summary: Procedure for refund of unutilised Input Tax Credit (ITC) for exported electricity requires filing FORM GST RFD-01 under "Any Other" with Statement 3B and REA monthly statement, uploading export invoices, tariff agreements and refund calculation in Statement 3A. The relevant date is the last date of the month as per monthly REA. Refund amount follows rule 89(4) formula: zero-rated export turnover (REA scheduled energy x contracted tariff, using the lower of REA and invoice quantities) multiplied by Net ITC divided by Adjusted Total Turnover, excluding domestic electricity turnover.

      TRADE CIRCULAR No. 07/2022 - dated 29-9-2022
      Prescribing manner of re-credit in electronic credit ledger using FORM GST PMT-03A
      Summary: Re credit is available where a taxpayer deposits an erroneously sanctioned refund with applicable interest and penalty by debiting the electronic cash ledger through FORM GST DRC 03; the taxpayer must state the reason in the payment text box and, until portal automation exists, submit a written request in Annexure A to the jurisdictional proper officer. The proper officer, after verifying full payment via FORM GST DRC 03 and applicable interest under section 50 and any penalty, shall re credit an equivalent amount to the electronic credit ledger by order in FORM GST PMT 03A, preferably within 30 days from request receipt or payment date.

      New initiative to make the tax administration more accessible to the taxpayers
      Summary: Senior tax officials from the Directorate will hold in person interactions with registered taxable persons and stakeholders in their jurisdictions during specified weekly designated timeslots; the circular lists responsible units, the senior officers for each office, and provides office addresses, while names, phone numbers and e mail addresses of designated officials are published on the Directorate website under the Ease of Doing Business tab.

      Guidelines for filing/revising TRAN-1/TRAN-2 in terms of order dated 22.07.2022 & 02.09.2022 of Hon'ble Supreme Court in the case of Union of India vs. Filco Trade Centre Pvt. Ltd.
      Summary: The Supreme Court directed temporary reopening of the GST common portal permits a one time filing or revision of FORM GST TRAN 1/TRAN 2 for transitional credit, requiring upload of Annexure A and TRANS 3 where applicable, consolidation of TRAN 2 claims into a single form, submission of a self certified copy to the jurisdictional officer within seven days, and preservation of supporting records; submitted forms become frozen upon filing, claims will be verified by officers who will pass orders and, if allowed, reflect credit in the Electronic Credit Ledger.

      Summary: Rule 95A of the Tamil Nadu GST Rules, which provided refunds for inward supplies to outgoing international tourists at airport departure areas, was omitted retrospectively, and consequently the Commissioner has withdrawn Circular No. 78/2019-TNGST ab initio, nullifying the earlier clarifications and aligning state administrative guidance with the central revenue circular and the amended statutory framework.
