Summary: The Delhi High Court held Rule 5A ultra vires and confined the power to initiate service tax audits to the statute, requiring the Commissioner to have reasons to believe specified conditions-misdeclaration of taxable value, irregular or fraudulent credit utilisation, or dispersed operations-before directing a chartered or cost accountant to audit an assessee's accounts; routine, unexplained demands for voluminous records or self-prescribed annexures do not satisfy these statutory preconditions.

Summary: Rule 5A(2) of the Service Tax Rules, requiring production of records to departmental or external audit parties, was held ultra vires because the Finance Act permits only a special audit in specified circumstances; non statutory instruments like the Service Tax Audit Manual and CBEC instructions cannot expand statutory audit powers.

Summary: Rule 5 of the Point of Taxation Rules, 2011 makes invoice issuance and receipt of payment the determinative events for tax liability on newly taxable services, thereby shifting the operative date away from the taxable event of provision or completion of service established by the charging section of the Finance Act. The article argues this exceeds the rule making powers under section 94, which permit rules for collection, recovery and related matters but do not authorize recharacterising the date of levy.

Summary: Determination under the Customs Act prescribes specific conversion rates for foreign currencies for customs purposes, with separate rates for imported goods and for export goods, superseding the earlier notification and applying from the notified date. Two annexed schedules list unit and per-hundred-unit rupee equivalents for the listed currencies to be used by customs officials in valuation and related procedures.
Summary: The Foreign Exchange Management Act framework facilitates external trade and payments while managing the capital account cautiously to prevent destabilising short term flows. Policy preferences favour long term, stable investment such as foreign direct investment, with sectoral caps and automatic or approval routes; portfolio investment is constrained by single investor and aggregate limits and valuation/exit rules for unlisted equity have been liberalised to permit internationally accepted arm's length methodologies. Debt flows are steered toward long dated instruments through limits and maturity requirements; overseas investment and NRI/PIO access are permitted subject to specified asset exclusions, funding channels and compliance obligations.
Summary: State Governments compile Per Capita Income and GDP estimates. The central government advances measures to raise per capita income-skill development, a technology driven second green revolution, industrial corridors, Smart Cities, sectoral incentives and duty rationalisation. To contain inflation, the Government adopts trade and regulatory interventions-delisting certain produce from state marketing laws, duty reductions, export restrictions, stock limits, suspension of futures trading, inclusion under the Essential Commodities Act-and Budget proposals including a Price Stabilization Fund, national market reforms, farmers' markets and restructuring of the public distribution system, complemented by monetary measures to moderate demand.
Summary: The Reserve Bank of India publishes Reference Rates for major currencies, specifying the US dollar and Euro benchmark values for the business day, with prior day comparisons and derived exchange rates for other currencies via cross currency middle rates; it also provides that the SDR Rupee rate will be based on the published Reference Rate.

Rate of exchange of conversion of each of the foreign currency with effect from 08th August, 2014
Summary: The Central Board of Excise and Customs, under authority of the Customs Act, fixes exchange rates for conversion between specified foreign currencies and Indian rupees for customs valuation, superseding the prior notification. The notification prescribes distinct rates for imported and export goods, set out in Schedule I (per unit rates) and Schedule II (per 100 units), to be applied for customs purposes from the notified effective date, with savings for actions completed prior to supersession.

Export benefits / incentives against exports to Iran.
Summary: Export proceeds from exports to Iran realized in local currency are permitted to avail export benefits and incentives under the Foreign Trade Policy at par with proceeds realized in freely convertible currency; this follows deletion of the word 'specific' from Para 2.40A, removing the limiting qualification and restoring parity of incentive entitlement for local currency realization.

To set up an IT/ITES Special Economic Zone at Kundalahalli Village, Krishnhrajapuram Hobli, Bangalore East Taluk, Bangalore in the State of Karnataka.
Summary: The Central Government de-notifies 8.56 hectares from the Special Economic Zone proposed by M/s. The action follows the company's proposal, a prior letter of approval for de-notification, the State Government's no objection, and the Development Commissioner's recommendation, and the notification lists the affected survey parcels with resultant area adjustments.
