      Principles laid down by SC (Civil Appeal No.1912 of 2015) in the case of Shri Ajay Kumar Choudhary Vs. Union of India in relation to Suspension order — Maximum time limit for suspension fixed 3 months, in case of no charge sheet served.
      Summary: Suspension time-limit is capped at three months if no Memorandum of Charges/chargesheet is served; if a chargesheet is served, any extension of suspension must be supported by a reasoned order. The direction to hold departmental proceedings in abeyance during criminal investigation is displaced. The Government may transfer an officer to sever contacts and may prohibit the officer from contacting persons or handling records until required to prepare his defence. Authorities must communicate the principles, review pending cases, and reference the judgment in post-revocation transfer orders.

      Guidelines for applying/obtaining quota for export of sugar to USA under Tariff rate quota (TRQ).
      Summary: APEDA will allocate TRQ quota for export of raw sugar to the USA by issuing Registration-cum-Allocation-Certificates (RCAC) after sealed applications; allocations are awarded by highest FOB price in USD per MT, with identical prices allocated pro rata. Applications must include a performance bank guarantee equal to 5% of the FOB value in Indian Rupees and processing charges per MT. RCACs run for 90 days with one 30-day extension possible; exporters must submit export details within 15 days of RCAC expiry and non-shipment may lead to invocation of the bank guarantee and reallocation of surrendered quantities.

      Examination/Inspection of imported goods without Delivery Order, however the Docks/CFSs release the cargo only after production of same w.e.f. 22nd June, 2015
      Summary: Customs will permit examination/inspection of imported goods without insistence on the Delivery Order: docks/CFSs shall present goods for Customs inspection upon registration even if the Delivery Order is not yet produced, but release of cargo from docks/CFSs will occur only after production of the Delivery Order.

      Clarification on repayment of deposits accepted by the companies before the commencement of the Companies Act, 2013 u/s 74 of the said Act - Companies can repay deposits in accordance with t & c for which deposits were accepted.
      Summary: Depositors may apply to the adjudicatory body exercising tribunal powers for non-repayment, and companies may seek time extensions; companies may repay deposits accepted before commencement in accordance with the original terms and conditions, subject to conditions in the Acceptance of Deposits Rules, and registrars may initiate prosecution for failures to repay.
