Credits for services used exclusively by one unit go solely to that unit; where services are used by multiple units, distribution is pro rata based on ex-duty turnover for the relevant prior period. Distribution is effected via ISD challan and is subject to reversal rules.

      Summary: The Agreement allocates taxing rights between India and Malaysia, applies to residents and taxes on income, defines residency and permanent establishment rules, prescribes attribution of business profits to permanent establishments on an arm's length basis, and limits source state withholding on dividends, interest, royalties and technical fees subject to specified maximum rates and exceptions where amounts are effectively connected with a permanent establishment. It establishes mutual agreement procedures, exchange of information obligations, limitation of benefits rules, non discrimination protections and mechanisms for elimination of double taxation by tax credits.

      Amendment in Para 3.2.1 of Handbook of Procedures Vol. I (RE 2012)/ 2009-14.
      Summary: The amendment to Para 3.2.1 specifies that applications for Status Recognition shall be filed with the concerned jurisdictional Regional Authority/Development Commissioner of DGFT. It further clarifies that where export performance of EOUs/SEZs is clubbed with a company/firm/Group Company in the domestic tariff area, such cases will continue to be considered only by the jurisdictional RA of DGFT, and that EHTPs and STPs shall file status recognition applications with their jurisdictional RAs.

      Summary: Bank guarantees furnished for duty free import of gold, silver, platinum and related items may be reused for subsequent consignments where the importer has fulfilled export obligations and export proceeds for earlier consignments have been realized; the guarantee must be sufficient to cover the duty involved and remain valid for an adequate period with a self renewal provision, and field formations must ensure continued validity until proceeds are realised.
